"Completely Full All the Time": What New York's Senior Day Care Billing Investigation Is About

A room full of empty tables and chairs

The head of CMS says this day care billed like it was always full.

That line comes from what Fox News reported on October 20, when federal officials walked into senior day care centers across New York City. Here's what officials say happened, what the centers said back, and why I think it matters for anyone who pays a health care bill.

What Happened on October 20

According to Fox News, CMS officials made more than 80 visits that Tuesday and delivered warning letters to providers across New York City. The FBI, the Department of Health and Human Services Office of Inspector General, the NYPD and other agencies took part, and searches were carried out at other locations around the city.

The FBI said in a statement to ABC7 New York that it was conducting law enforcement activity in Queens, Staten Island, Brooklyn and other parts of the city in connection with ongoing federal investigations. Authorities told ABC7 they believe some centers overbilled for services, inflated the number of clients served and engaged in kickbacks. ABC7 reported two arrests on Staten Island.

"As Though It's Completely Full All the Time"

Fox News reporters went with the head of CMS to a center in Flushing, Queens. He told the director, "The bills we're getting are as though it's completely full all the time." He also said, "It doesn't look very crowded here."

Fox noted a posted maximum occupancy of 70. The head of CMS questioned why billing showed seniors attending five days a week when the director said many come two or three days.

What the Centers Said

The director told Fox the center bills only for seniors who actually attend and requires them to sign attendance sheets. The director said it was still early and more seniors would arrive later that morning. At a second center, a manager said some seniors were in classes or out at appointments.

None of the centers has been convicted of anything in this investigation. Warning letters and searches are not charges, and the investigation is ongoing.

Billing for an Empty Room

Whatever happened at any one center, the problem investigators describe is simple: a bill gets paid because nobody holds it up against what really happened.

New York State officials say they're now directing health plans to run prepayment review on these claims. That's a fancy way of saying: check the bill before you pay it.

You should be able to do that too, and at a pharmacy you can.
